Este artigo tem por objetivo tratar, ainda que de forma sucinta, de uma alteração recente no sistema falimentar brasileiro que tem o potencial de acelerar uma mudança cultural e alterar a forma como processos de recuperação de empresas são conduzidos no Brasil, seja prevenindo o ajuizamento de processos que podem ser evitados, seja auxiliando para que os processos de recuperação, quando inevitáveis, tenham uma maior probabilidade de êxito.

This article aims to address, albeit briefly, a recent change in the Brazilian bankruptcy system that has the potential to accelerate a cultural change and modify the way business reorganization proceedings are managed in Brazil, whether preventing the filing of proceedings that can be avoided, or helping to ensure that the reorganization proceedings, when unavoidable, have a greater probability of success.
